These Terms of Service ("Terms") form a legal agreement between you and Festival Candy Master ("we," "us," or "our") and govern your use of the Festival Candy Master mobile application and related materials (collectively, the "Service"). By installing, accessing, or using the Service you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is a casual, simulated, fictional patisserie-atelier collection-and-progression game. No real betting takes place. There's no betting in this app. No real-money winnings. The Order Board and Triple Mix are decorative patisserie animations that display fictional sweet categories and ingredient symbols as ambient atelier atmosphere; they are non-wagering and provide no real-money or prize-based functionality of any kind. All sweet imagery and the pastry-master character are AI-generated. The patisserie, the location, the festival, customer orders, and every Sweet 5 Legendary depicted in the Service are fictional. The Service does not include in-app purchases and offers no cash prizes.
The Service is intended for users who are at least 13 years old (or the age of digital consent in your jurisdiction). By using the Service you represent that you meet that requirement and have the legal authority to accept these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Service on devices you own or control, for personal, non-commercial purposes only.
You agree not to:
Game state created within the Service (your atelier name, address selection, card collection, fusion history, Sweet 5 progress, streak, rank, energy timer, and Confectioner's Path journal entries) is stored locally on your device. We do not access, transmit, or back up that content. You are solely responsible for backing up your own data.
The Service, including its visual identity, AI-generated sweet artwork, AI-generated pastry-master character, fictional patisserie brand names, Confectioner's Path journal text, and underlying software, is owned by us or our licensors and protected by copyright, trademark, and other applicable laws. Nothing in these Terms transfers ownership of any intellectual property rights.
The Service may rely on third-party services (e.g., Google Play Services, Firebase Cloud Messaging, AppsFlyer, OneSignal). Your use of those services is also subject to their own terms and privacy policies. We are not responsible for the practices of those third parties.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Confectioner's Path entries and any culinary references depicted within the Service are offered for general atmospheric reading; they are not a substitute for actual pastry instruction, recipes, or food-safety guidance.
To the maximum extent permitted by law, Festival Candy Master shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
You agree to indemnify and hold us harmless from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or where required by applicable law. You may stop using the Service at any time by uninstalling it.
We may update the Service and these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page. Your continued use of the Service after the change indicates acceptance of the revised Terms.
These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-laws principles. The courts located in that jurisdiction shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
